Goodcam acts as the data controller of the personal data processed pursuant to this Privacy Policy.

The personal data we collect about you

We may collect, use, store and transfer the following kinds of personal data about you:

  • identity data includes first name, last name, username or similar identifier;
  • contact data includes billing address, delivery address, email address and telephone numbers;
  • financial data includes bank account, but excludes the payment card details;
  • transaction data includes details about payments to and from you, purchases or orders made by you and other details of products and services you have purchased from us;
  • technical data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, device ID and other technology on the devices you use to access this website;
  • usage data includes information about how you interact with and use our website, products and services.

How we collect your personal data

We collect your personal data when you use and/or interact with us through this website and our online store (the “Goodcam Online Store”). We may also collect your personal data when you contact us by email or other means of communication to request support or to discuss how we can help you meet your business needs.

We employ the below methods to collect your personal data.

a.   Your interactions with us. You may give us your personal data by filling in online forms or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you:

  • create an account on our website;
  • create an account on the Goodcam Online Store;
  • order products from the Goodcam Online Store;
  • request our support;
  • give us feedback or contact us.

b.   Automated technologies or interactions. As you interact with our website, we will automatically collect technical data about your equipment, browsing actions and patterns. We collect this personal data by using cookies and other similar technologies.

c.   Technical data is collected from analytics providers, such as Google.

d.   Contact, financial and transaction data is collected from providers of technical, payment and delivery services.

How we use your personal data

Legal basis

The law requires us to have a legal basis for collecting and using your personal data. We rely on one or more of the following legal bases:

a.   Performance of a contract with you: Where we need to perform the contract we are about to enter into or have entered into with you.

b.   Legitimate interests: We may use your personal data where it is necessary to conduct our business and pursue our legitimate interests, for example to enable us to give you the best and most secure customer experience. We make sure we consider and balance any potential impact on you and your rights (both positive and negative) before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).

c.   Legal obligation: We may use your personal data where it is necessary for compliance with a legal obligation that we are subject to. We will identify the relevant legal obligation when we rely on this legal basis.

d.   Consent: We rely on consent only where we have obtained your agreement to use your personal data for a specified purpose.

Purposes for which we will use your personal data 

When you register an account with us to connect your camera to our cloud, we require you to provide us with identity data, namely a username and password. We use this information to perform a contract with you. We will retain the personal data as long as you keep the account open.

When you register an account with the Goodcam Online Store to manage your online orders, returns or refunds, we use the identity, contact and transaction data. We use this data to perform a contract with you. We will retain the personal data as long as you keep the account open.

When you order products from the Goodcam Online Store, we use the identity, contact, financial and transaction data in order to manage payments, fees and charges, deliveries and returns, and fulfil our accounting and tax obligations. We use this information to perform a contract with you (sale of goods), pursue our legitimate interests (recover debts due to us) and to fulfil our legal obligations (tax and accounting). We will retain the personal data for as long as is necessary to deliver the products to you, to administer warranty claims and to fulfil our other legal obligations relating to the sale of the products. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you. By law we have to keep basic information about our customers (including contact, identity, financial and transaction data) for ten years after they cease being customers for tax purposes.

When you request a support from us, we use your identity and contact data. We use this information to perform a contract with you. We will retain the personal data as long as necessary to process the case, but for no longer than three months after the case has been closed. After we analyse the personal data, we will anonymise it so that it can no longer be associated with you for research or product-development purposes, in which case we may use this information indefinitely without further notice to you.

When you contact us to discuss your business needs, explore possibilities for business cooperation, or for any other reason, we use your identity and contact data in order to communicate with you. We use this information to pursue our legitimate interests (to help us improve and develop our products and services or address our customers’ needs). We will retain the personal data as long as necessary to process the communication, but for no longer than twelve months after the communication has ceased.

When you interact with our website, we will use the technical and use data in order to improve our website, products/services, customer relationships and experiences and to measure the effectiveness of our communications and marketing. We use this information to pursue our legitimate interests (to define types of customers for our products and services, to keep our website updated and relevant, to develop our business and to inform our marketing strategy). We only retain anonymised data which cannot be associated with you in any way, and we keep it for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

Payment gateways

The Goodcam Online Store contains links to payment gateways provided by third parties which you may use in order to make payments for our products. You will have to fill in your personal data related to the payment when using the payment gateways. This data is processed by the relevant payment gateway provider as the data controller and the data processing is governed by the payment gateway provider's terms and conditions and privacy policy. We do not process this information and we do not have access to this information. We will always include the name of the payment gateway provider on the Goodcam Online Store so that you can contact them for full information about how they handle your personal data.

How long we store the personal data

Details of retention periods for different aspects of your personal data are set out above. As a general rule, we will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. In some circumstances you can ask us to delete your data.

Disclosures of your personal data 

We take care of your personal data security and so we choose the partners to whom we entrust your personal data very carefully. All our partners must be able to provide sufficient security of your personal data to prevent unauthorised or accidental access thereto or other abuse thereof and all our partners must undertake a confidentiality obligation and must not use your personal data for any purpose other than the purpose for which the data were made available to them.

The recipients that may have access to your personal data are following:

  • providers of accounting, legal and administrative services;
  • providers of shipping services;
  • providers of data analytics;
  • third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.

International transfers of personal data

Whenever we transfer your personal data out of the European Economic Area to service providers, we ensure a similar degree of protection is afforded to it by ensuring that the following safeguards are in place. We will only transfer your personal data to countries that have been deemed by the European Commission to provide an adequate level of protection for personal data, namely, to the United States to commercial organisations participating in the EU-US Data Privacy Framework.

Data security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Your legal rights

You have a number of rights under data protection laws in relation to your personal data.

You have the right to:

a.   Request access to your personal data. This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

b.   Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

c.   Request erasure of your personal data in certain circumstances. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law.

d.   Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) as the legal basis for that particular use of your data.

e.   Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine‑readable format.

f.    Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent.

g.   Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in one of the following scenarios:

  • if you want us to establish the data’s accuracy;
  • where our use of the data is unlawful but you do not want us to erase it;
  • where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or
  • you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
